if you have time (like vacation, travel out of US ...) available "recapture" them
You probably would have started work in Oct
And you cannot extended H1 beyond 6 yrs because your labor PD is less than a year

Cmon ever since independece we have never been united on any cause. I see threads from Gandhigiri(sending roses)...TO .. "no work on 13th"petition. But cmon look at the responses, e.g. no working day petions had only 75 votes , of which most are scared to put there employer name info. etc.
75 here 120 there..do you guys really think with these numbers will make our voices heard .. On the other end lot of people are happy about the revision of the July bulletin and yes that includes the ones stuck in BEC (hypocrisy check! ) and the desi employers who perhaps were fasting/praying or something for this to happen... :-)
Its a number's game. We will never make our voices heard unless we can join hundred of thousands for a cause. I appreciate what IV has attempted to do, but it's an inherent problem with people like us, every one is out there trying to get ahead of the line. If given the choice most would exploit each other to take advantage. I mentioned "desis" perhaps, the problem we face is quite fitting to people from populous nations. I think we are looking at the problem from a very micro level(green card backlog).. The glut in immigration is nothing new and represents similar issues faced in India or China etc.
I am sounding completely pessimistic, but its the harsh reality. Perhaps we are not tuned to be united, we've been raised, bred to be just competitive and anything else which is a byproduct of competition.
just my 2 cents.
pls before anyone starts shouting at my post. Throw the hypocrisy out of the door and then reply.

Another recent story on Canadian Skilled Immigration...

CALGARY - Alberta and the rest of Canada need to move quickly to boost immigration and take better advantage of skills so many new Canadians bring to their chosen home or risk being left behind in a global race for talent, says the head of Canada's largest bank.
''We must significantly increase these efforts and others if Canada is going to have the necessary human resources to compete in today's global economy,'' Royal Bank of Canada president/chief executive Gordon Nixon said to a dinner of the Immigrant Access Fund in Calgary Tuesday evening.
''Make no mistake, Canada is in a global war for talent. We must be a destination of choice for skilled immigrants and professionals or we will not succeed ... If we do, we will have a unrivaled advantage. If we don't, we will face an uphill battle just to maintain our quality of life.''
David Baxter, a demographer and economist with the Vancouver-based Urban Futures Institute Society, agrees with Nixon's analysis, suggesting Canada faces a ''perfect storm'' of demographic labour force pressures. Those factors include a declining birthrate, a massive number of Canadians approaching retirement and relatively fewer Canadians entering the workforce as they reach working age.
''You don't need a robust economy to be able to say there's going to be a problem here. We're probably now at the point now that without immigration our labour force stops growing,'' he said. ''This is a long-term issue, let's regularize it. We've got to move away from this talk of temporary (workers).
''What I would look for is young, healthy, intelligent, honest energetic people, preferably with an entrepreneurial spirit - and more employee sponsorship.''
Nixon argued that nowhere is the potential of immigrant expertise and contribution more evident than in Calgary, which is suffering labour shortages across the board, in all industries, from the unskilled worker to the skilled professional.
''Calgary is facing a shortfall of as many as 90,000 workers over the next five years ... by 2025 the shortage across the province will be well through 300,000,'' said Nixon. ''Alberta is at the cusp of a trend we're seeing nationwide.''
Nixon argued that immigration must be viewed by policymakers as a strategic economic development tool that will help to define 21st century Canada. He noted the country has in the past used immigration as a tool of industrial policy, particularly around the settlement and development of the West.
That kind of approach is needed again, Nixon asserted, as is better utilization of under-employed immigrants already in Canada, a phenomenon that RBC economists has estimated costs Canada $13 billion annually.
''We can no longer view immigration as a temporary employment agency,'' said Nixon. ''We need to start looking at immigration as a blueprint for nation-building, and we must find the right balance between social justice and economic need.''
Baxter believes that Alberta is making the strongest effort of any of the Canadian provinces to attract and efficaciously absorb new Canadians. However, he noted that while immigration policy remains largely the purview of the federal government, questions of professional accreditation and other determinants limiting immigrants' entry into the Canadian workforce rest in provincial hands.
''Alberta is at the forefront of this. The provincial government recognizes this (the need for more workers) and so does industry,'' said Baxter, referring to Alberta's Labour Force Strategy, released in July.

I guess employer need to revoke unused H1Bs as part of H1B rules. Maybe that is the reason employer revoked past H1Bs to keep their side clean.
I remember reading Murthy bullettin where she mentioned back-wages are an issue if H1B is not explicitly revoked.
My guess.
My previous attorney also mentioned the same thing. Looking at this thread it seems all soft/hard lud's were generated on Sunday, April 26th. Maybe a computer program flagged these cases.

In case his I-140 was approved then there are no problems for this scenario right?
yes if I-140 is approved it makes a world of difference:
- keeps his GC process alive even if he changes employers since he is past the 180 day mark of 485 filing.
- he gets a 3 year H1 extension/transfer if his PD is not current.
thats the reason I advise him to hang on until the I-140 comes through; esp since he has a 2004 PD and its an utter waste of four-five years if that goes.
Even if employer is not treating you well, hang in there and smile; your turn to get even-steven will come soon enough.

Search for "six-month rule", in "trave.state.gov"
If you tell me which country passport you hold, I could tell whether you are exempt from this 6-month-rule or not.
And yes, I mean official requirement for "entry".
How you think H1B documentation will act as a proof of "permanent residence" intention?
Thanks for your reply Morchu. I want to have some further clarification here:

This one was posted originally at http://immigrationvoice.org/forum/archive/index.php/t-20450.html. Just replace USVI with Hawaii.
USVI is a US territory hence, you will be able to fly in with the drivers license. They do not take your I 94 back. Just to make sure you are in US territorial waters, don't swim or wade out more than 5 feet out in the water. You could be swimming in international waters without proper US exit authorization. Your entry to shore could be subject to unauthorized landing. A water tight bag lugged around your fanny with passport/I94/H1B/paystubs/employer letters/DL(Driver License)/EAD(Employment Authorization Document)/AP(Advanced Parole)/receipts/etc etc. should keep you safe though. Just keep it away from the sharks. Enjoy your vacation.:D:D:D

This is what I can speculate from logical point of view. There can be an 2nd RFE which is basically seeking more clarification on an earlier RFE. These kind of RFE will be pretty much immediate to the preceeding RFE (within 1 -2 months)
After that hopefully there should not be any unrelated RFE with the assumption that IO has taken a complete look at the file before issuing a RFE. We do not want a RFE for BC and when that is replied IO sending another one for Medical or Marriage Certificate. We should reasonably assume that IO has taken a good look at the application before sending RFE.
But we can expect RFE for cases that are current. The reason being most of these cases might be lying with CIS for over 2-3 years before getting current and considering the current state of economy they might issue a RFE for updated EVL to check if the person is still working. That is again just a pure guess no one knows how CIS works in reality
eb2_mumbai,
Most your recent postings are logical but still so much red here- I gave you green.

Hi cakewalkr7!
For your first question, the reason is that when animating, the height of an element is not what gets changed by default when you use the adorners. A RenderTransform with ScaleY changes instead.
What you want to do is set the actual Height property to 0 on the properties inspector at a given keyframe. That should give you the effect that you want. Here is a small XAML snippet that allows you to do that:
<Window.Resources>
<Storyboard x:Key="Storyboard1">
<DoubleAnimationUsingKeyFrames BeginTime="00:00:00" Storyboard.TargetName="grid" Storyboard.TargetProperty="(FrameworkElement.Height)">
<SplineDoubleKeyFrame KeyTime="00:00:00.5000000" Value="0"/>
</DoubleAnimationUsingKeyFrames>
</Storyboard>
</Window.Resources>
<Window.Triggers>
<EventTrigger RoutedEvent="FrameworkElement.Loaded">
<BeginStoryboard Storyboard="{StaticResource Storyboard1}"/>
</EventTrigger>
</Window.Triggers>
<Grid x:Name="LayoutRoot">
<StackPanel>
<Grid Height="100" Background="#FFF5FF00" x:Name="grid"/>
<Grid Height="100" Background="#FF00B3FF"/>
</StackPanel>
</Grid>
For your second question, there isn't an easy way to do that without writing code. This tutorial should help: http://www.kirupa.com/blend_wpf/modifying_animations_pg1.htm What you would vary is the Storyboard.TargetName, and that would point to the appropriate Grid that you are interested in animating.
Let me know if that helps or if you need more info.
Cheers!
Kirupa :)

I see that Dream Act folks are trying to get > 60000 points, to showcase their support. We need to match for the posts like Legal Immigration in there. Currently the top posts for "legal immigration" are around 2000 points. Not many ppl are not taking interest.
Please vote up on our causes! Easy job..but please act!
I think anti-immigrant groups are voting down on pro-immigrant policies. So, one should vote down on all anti-immigrant policies as well. Just voting up on pro-immigrantion policies wont help I guess

Is that what you meant ?
If yes - then i try doing that every time i go for H1B stamping... Talking as if you a temp worker going to US for helping with some extra work ...
That gives the consular officer a comfort feeling probably !
Agreed. As per my understanding, "consulting" as per the bill's definition is:
1. You are working at another employer's location (or client location)
AND
2. You report to someone at the other employer's location (i.e. you report to someone in the client's office)
So technically, you can still "consult" if you claim that you are reporting to your "employer" and not to someone at the client's location. And the show will go on.
This is my understanding of the bill. There are a lot of people who disagree with my interpretation.
Remember though, the true danger from the bill is the removal of the clause that H1B and L visa holders need not prove to the visa office that they do not intend to immigrate to the US.

The only reason why the House hasn't given in on CIRA is because of the incessant pressure of restrictionists such as NUmbersUSA activists. Look at how active they are. Granted one has to be a Citizen to vote, but the first amendment gives us ALL the right to free speech and express ourselves. That is why IV is legal, and that is why the least we can do is a webfax campaign regarding Skilled Immigration (SKIL bill) AND show up at local meetings with Congressman.
Believe me, if we don't speak up, no one is going to do it for us. People like me with 02 priority dates are going to wait atleast two more years, folks who filed in 05 may get to wait 5+ years for their GC. This is the way things look currently.
The Illegals like the Chamber of Commerce, the big lobby Ag, Hotel/Travel, Construction, Meat-Packing, Industries, the Catholic Church and big ethic lobbies like MALDEF, La Raza, besides millions of hispanic votes.
The other side also has the power of millions of votes and a LOUD VOICE.
We have nothing compared to them. You can see we are small fish...that is why we need to do all we can to make ourselves heard.

From: Roy Beck, President, NumbersUSA
Date: Friday 9JUN06 9:30 a.m. EDT
Please take some actions today .... and prepare for many more actions next week
DEAR SUPPORTERS OF LOWER OVERALL IMMIGRATION,
Thanks to all of you who -- in the two weeks since the Senate voted for a massive immigration increase and amnesty -- have been regularly checking your Action Buffet for new actions and who have been responding to the several Fax Alerts that we have sent you.
Now, it is time to really start turning up the heat again.
I'm asking each one of you to do at least one of the following TODAY.
Members of Congress are feeling great pressure from our side, but we must really escalate that pressure if we are to totally block all the immigration increases in the Senate bill. Thus far, the Republican majority in the House of Representatives has stood firm against the national Republican Party leaders and President Bush. We have a lot of hope that the House can hold the line against the amnesty/open borders plan of President Bush, the Republican National Committee and nearly all Senate Democrats. BUT IT WILL HAPPEN ONLY IF ALL OF YOU DO WHAT YOU DID IN APRIL AND MAY.
There are a lot more of YOU than there used to be.
Last Saturday, our Activist Membership crossed the 200,000 mark! That means we have almost 100,000 more of you working together in this cause than we had last December when we pressured for toughening amendments to the House-passed H.R. 4437.
Action No. 1: Send all the faxes that have accumulated on your Action Buffet corkboard.
We can tell from the number of faxes that have been ordered over the last two weeks that many of you have taken a much-deserved break from activism and not been sending the new faxes we have posted on your customized corkboard.
Please go now to:
www.NumbersUSA.com/actionbuffet
Action No. 2: Tell us when and where your Senators and Representative are holding town hall meetings
You should see a thumb-tacked note on your corkboard asking for this information. When you click on the note, you will go to a page that will give you good instructions for how to track down this information.
There is no central place to find out when and where Members of Congress expose themselves to the voters. In fact, they try to keep it as secret as possible because they don't really want to have to hear directly from you.
That is why the town hall meeting part of our Action Buffet is so very important.
NumbersUSA doesn't have the staff to dig out potential meetings of all 535 Members of Congress. We MUST rely on you to send us that info on your own Members so we can share with everybody else from your state and District.
Click on corkboard note to send us town hall meeting information
Action No. 3: Attend any meeting or event where your Senators or Representative are expected to appear
Nothing you do will be as powerful as attending in person one of the events where your Members of Congress appears, and then asking a question or making a statement about immigration -- or even holding up a sign giving your view on immigration -- or applauding another voter who expresses your opinion on immigration.
You all have become great faxers and phoners. But we must have many, many more of you personally confronting the Members of Congress -- especially the ones who have Immigration Grades ranging from F-minus to B.
See your Members' immigration grades at:
www.CongressGrades.org
If you see a thumb-tacked note on your corkboard that announces a meeting of one of your Members of Congress, PLEASE LOOK AT IT -- and make plans to attend.
Get some friends to go with you to ensure that you will have a cheering section.
And be sure to use the feedback devices on our page that allow you to easily let us know you are planning to attend and to give us a report when you return.
Action No. 4: Call some friends or let us know that you plan to visit the local office of your Representative or one of your Senators next week
These Members of Congress must have voters in their local offices putting the pressure on their staffs to block the Senate amnesty and immigration increases.
If you are interested in doing this but don't want to go alone, send us an email through our Help Desk form and we will put you in touch with other people in your area who are trying to make a trip.
PLEASE NOTE: We have a new way of your communicating to us in which you cannot just hit REPLY to our Alerts anymore.
We are not trying to make things difficult for you. But with 200,000 members, our staff simply has not been able to keep up with your emails. We have hired two interns for the summer to help Jon and Jeremy. But we also must create a better system of categories if we are to provide the level of service we once did.
So, you should always communicate with us by:
(a) clicking on the CONTACT US link in the navigation bar at the top of our web pages. That takes you to the HELP FORM link.
(b) or putting this address in your directory and regularly using it:
www.numbersusa.com/helpform
On the Help Form page, you choose the category in which you are writing and send us an email that way.
Thousands of people have already started using this form in the last month, and it is accelerating our ability to respond.
======================================
Thanks for jumping into this TODAY before you move into your weekend family and recreation activities.
Then, please, plan to do something Monday and during the rest of the week.
We will be sending you additional guidance on how best to stop the amnesty -- or at least keep it from passing this month. The longer we can delay this, the better our chances are of winning.
Thank you,
-- ROY

======================================
Thank you,
-- ROY

The point here is that this is wrong
1. Extra cost for Immigrants, It is expensive 400 Dollars
2. There is no logic for this medicine - It makes immigrants guinea pigs for this vaccination. It is clearly a result of lobbying effforts from Pharma companies.
If We do not appose (or I should say expose) it now then u never know what all they will keep piling on in medical exams and very soon that 5% figure that u talked about will be 100%.
Also IV is for Legal Immigration for all nationals, I am sure more than 5% of IV members are getting effected.
It is highly unethical to make this vaccine mandatory for immigrants (girls in age group 11-26) and not for citizens.
Only the Pharma companies and committe members (as they must have been bribed) are gaining out of this.
It is going to bring an estimated 40 million dollar annually to Merck.
Not to mention the extra paper work for us immigrants and RFE's on medicals for people who has already completed the paper work and are waiting in the lines.
This vaccination is for ladies only and in age group 11 to 26, that really means only 5% of Indians will be effected with the wait times we have been looking at.

If you start now and if get ur labor in 2-3 months chances are good for Eb2 that dates will be close to current by end of next year. So u can have EAD.
If congress passes HR 5882 then Eb3 should be current. Depends on company I 140 is not taking more than 1 year average for non concurrent filling.
Assuming some relief to EB community Eb2 will take 2-2.5 years and Eb3 may take upto 4 years. Everything is based on assumption here.
To get GC you need to be in line sooner or later then why not now..

He Leo. You are great. Thanks a lot. It appears that they have my fp when I applied previosly for security clearnace. or Port of Entry.
Thanks
REQUIRE_GC
When they do FP, they tries to match with criminal database. Why do they want to match to the Port of entry or Security clearance database and give RED color warning. I think it is something you need to work with your attorney. Even in Name check, they tries to match with Criminal first, middle or last names and if match found, they do some investigation on your case. Same logic goes with FP. They won't match with good records, but they tries to search in bad records. It is simple common sense. Nothing to panic, but check with your attorney.
Thanks
